General Terms of Use of ICIA

Welcome to ICIA. These General Terms of Use (hereinafter the “Terms of Use”) define the rules for accessing and using the service. You are invited to read them carefully. By using the service, you accept these terms.

The ICIA service (hereinafter “ICIA” or the “service”) is published by:

Hosting

The service is hosted by:

Cloudflare acts solely as a technical intermediary for managing domain names (DNS) and redirecting addresses. It does not host the service’s data.

Article 2. Purpose and acceptance of the Terms of Use

These Terms of Use are intended to define the conditions under which you access and use the ICIA service. They constitute a contract between you and Mentivis.

By creating an account or using the service, you acknowledge that you have read these Terms of Use and agree to comply with them. If you do not accept these conditions, you must not use the service.

These Terms of Use apply to all users, whether or not they have an account, as soon as they access the service.

Article 3. Description of the service

ICIA is a free web platform open to everyone that allows you to learn with free access. It provides educational content organized into pathways, modules, courses and exercises.

The educational content offered is generated by artificial intelligence. It is produced automatically based on your goals and, where applicable, the documents you upload, in order to personalize your training.

The service operates on a so-called freemium model. It is free in its basic version, which includes usage limits, for example a number of sections accessible per day or a number of simultaneous pathways. The service may offer you an extended plan (“Go Pro”) to increase these limits. As of today, the service is entirely free. Paid plans may be introduced in the future, under the conditions set out in Article 11.

Article 4. Access to the service and registration conditions

Access to certain features requires the creation of an account. Registration is free.

The service is open to everyone, including minors, under the following conditions:

• Minors aged 15 or over may create an account on their own.
• Minors under 15 must have obtained the prior consent of a holder of parental authority. By registering, the user declares that they have such consent.

A holder of parental authority may at any time request the deletion of their child’s account by writing to dpo@mentivis.com.

The service does not offer sensitive content. It is up to everyone to comply with the age conditions set out above.

Article 5. User account

You can create an account in two ways: with an email address and a password, or by using a third-party account via Google or Microsoft sign-in (SSO). When you use SSO, the chosen provider confirms your identity and sends us certain information needed to create your account, namely your email address, your name and a unique account identifier.

You are responsible for the confidentiality of your login details and for any activity carried out from your account. You agree to choose a strong password, to keep it secret and to inform us without delay of any unauthorized use of your account. Account or credential sharing is not permitted.

Profile data

During registration, certain information is required to enable the creation and management of your account and the personalization of your training:

• email address
• password (stored in hashed, non-reversible form)
• last name
• first name
• postal code
• country
• training objective

The postal code and country allow us to adapt the service to your geographical context and to compile usage statistics by region.

Other information is optional and is provided only if you wish:

• telephone number
• uploaded documents (for example a CV)

The documents you upload are used solely to operate the service and personalize your training. You can delete them at any time from your personal area. These documents are never used to train or improve artificial intelligence models.

The processing of your personal data is described in Article 10 and in the Privacy Policy.

Article 6. Warning regarding content generated by artificial intelligence

The educational content provided by ICIA is produced by artificial intelligence systems. To generate your training, the service sends the necessary information to third-party artificial intelligence providers, including, where applicable, the content of the documents you upload. Some of these providers are located outside the European Union. The procedures, recipients and safeguards applicable to these transfers are specified in the Privacy Policy.

Despite the care taken in their generation, this content may contain errors, approximations or inaccuracies.

You must maintain a critical mindset and verify important information with reliable sources. The service’s content has a general educational purpose. It does not constitute professional advice and does not replace consultation with a qualified professional, particularly in the medical, legal or financial fields, or with regard to educational and career guidance.

You remain solely responsible for the use you make of the service’s content and for the decisions you take based on it.

Article 7. Acceptable use rules

You agree to use the service in a fair manner and in compliance with the law. The following are in particular prohibited:

• posting or uploading unlawful, hateful, defamatory or infringing content, or content violating third-party rights
• circumventing the service’s quotas, usage limits or technical protections
• automating access to the service, massively extracting its content (scraping), overloading it or compromising its security
• impersonating a third party or creating fake accounts
• sharing your account or your login details with a third party
• using the service or its content for commercial purposes without authorization

Failure to comply with these rules may result in the measures set out in Article 8.

Article 8. Suspension and deletion of account

At Mentivis’ initiative

In the event of a serious breach of these Terms of Use or unlawful use of the service, Mentivis may suspend or delete your account immediately and without prior notice. In the event of a minor breach, a prior warning is in principle sent to you before any action is taken.

At your initiative

You can close your account at any time, without having to give any reason. You can do so directly from your “My account” area or by writing to dpo@mentivis.com.

The consequences of closing the account on your personal data are described in Article 10 and in the Privacy Policy.

Article 9. Intellectual property

Educational content generated by artificial intelligence

The educational content generated by the service is made available to you free of charge for personal and educational use, without any transfer of rights. Any reproduction, distribution or exploitation for commercial purposes is prohibited without Mentivis’ prior authorization.

Brand and logo

The names “MentivisOS” and “ICIA” and the associated logo are not registered as trademarks as of today. They are protected under copyright and by virtue of their use. You may not reproduce or use them without authorization.

Content you upload

You remain the owner of the content and documents you upload to the service. By uploading them, you grant Mentivis a license strictly limited to what is technically necessary for the operation of the service, namely the storage of this content, its display for you and its analysis by artificial intelligence in order to generate your training.

This license is free of charge, non-exclusive and limited to the period necessary to provide the service. Your content is in no way used to train or improve artificial intelligence models.

Article 10. Personal data and cookies

Mentivis (SAS) is responsible for processing the personal data collected in connection with the service. The processing of your data is described in detail in the Privacy Policy, which forms an integral part of the information provided to you.

In summary, Mentivis collects the data necessary for the creation and management of your account, the provision and personalization of training, quota management, security and the fight against abuse, support, compliance with its legal obligations and, if you consent, the sending of information emails. Certain technical connection data (logs, IP address) is collected automatically.

To produce your training, certain data, including where applicable the content of the documents you upload, is transmitted to third-party artificial intelligence providers, some of whom are located outside the European Union. These transfers are governed by appropriate safeguards. The list of recipients, retention periods, legal bases and applicable safeguards are detailed in the Privacy Policy.

The address dpo@mentivis.com is a contact address dedicated to your personal data. As of today, Mentivis has not appointed a data protection officer within the meaning of the General Data Protection Regulation.

You have rights over your data: access, rectification, erasure, objection, restriction, portability, and withdrawal of your consent at any time. You can exercise these rights by writing to dpo@mentivis.com. You can also delete your account yourself from your “My account” area. Finally, you have the right to lodge a complaint with the French Data Protection Authority (CNIL), www.cnil.fr.

Cookies

As of today, the service uses only cookies that are strictly necessary for its operation, which do not require your consent. These include session and login cookies, security cookies, the cookie that records your choice regarding cookies and the cookie that records your display theme preference.

If other categories of cookies were to be activated, for example for audience measurement purposes or via third-party trackers, they would be subject to your prior consent, obtained via the cookie management banner. The procedures are specified in the Privacy Policy.

Article 11. Availability, changes to the service and limitation of liability

The service is provided free of charge and “as is”, without any guarantee of continuous availability or accuracy of the content. Reasonable means are used to ensure the proper functioning of the service, without guaranteeing that it will be free from interruption or error.

Mentivis may modify, update, suspend or discontinue all or part of the service, a feature or an account, at any time and without notice. Since the service is free, Mentivis is not bound by any contractual obligation of continuity.

Within the limits permitted by law, Mentivis cannot be held liable for damages resulting from the use or inability to use the service, nor for decisions taken on the basis of content generated by artificial intelligence, whose fallibility is recalled in Article 6. These limitations in no way cover gross negligence, wilful misconduct or bodily injury, and do not apply in cases where liability cannot be excluded under the law, in particular with regard to consumers.

The service is currently entirely free. Paid plans (for example a Pro plan) may be introduced in the future. If so, their terms and prices will be clearly communicated to you before any subscription, and no amount will be charged to you without your express agreement.

Article 12. Changes to the Terms of Use

Mentivis may amend these Terms of Use to adapt them to changes in the service, regulations or its practices. The applicable version is the one online at the time you use the service. The date of last update appears at the top of the document.

In the event of a significant change, efforts will be made to inform you by an appropriate means. Continued use of the service after the modified Terms of Use come into force constitutes acceptance of them. If you do not accept the new conditions, you must stop using the service and, where applicable, close your account.

Article 13. Governing law, disputes and mediation

These Terms of Use are governed by French law.

In the event of a dispute, you are invited to contact us at contact@mentivis.com in order to seek an amicable solution.

If you are a consumer, you benefit from the protective rules of consumer law. You may in particular bring your case before the court of your place of residence.

Since the service is currently entirely free, no consumer mediator has been appointed. If a paid offer were to be proposed, a consumer mediation scheme would be put in place and information on how to access it would then be provided to you.
